Nationwide Background Check Program for Youth Organizations Extended

Legislation to extend a pilot program that allows youth-serving organizations to obtain criminal background checks on volunteers and employees was passed by the House Thursday.

The bill, passed by 413-4, directs the Justice Department to coordinate with states to streamline the process for organizations that work with children. It builds on a successful pilot program created under a 2003 law, paving the way to make the program permanent.

According to bill sponsor Adam B. Schiff , D-Calif., more than 89,000 FBI fingerprint checks have been conducted under the pilot program and 6.1 percent of potential volunteers were found to have criminal records of concern. More than 40 percent of those individuals had criminal records in states other than where they were applying to volunteer — “meaning that only a nationwide check would have caught the criminal records,” Schiff said during floor debate on the measure earlier in the week.

Under the measure, non-profit organizations would pay not more $25 and a fee charged by the FBI for a nationwide background check. State and nationwide background check requests would have to be met within 10 business days.
Supporters from both parties emphasized the program’s proven success. The pilot program has “demonstrated that background checks for nonprofits working with children can be conducted quickly, affordably, and accurately,” Schiff said.

House Judiciary Crime Subcommittee Chairman Robert C. Scott , D-Va., added, “This is a non-controversial, fee-based program that has successfully provided invaluable information to mentoring organizations at no cost to the taxpayers. It makes sense now to make the program permanent.”

The bill has the support of a variety of national youth-serving organizations, including Boys and Girls Clubs of America and Big Brothers Big Sisters. Personally, I think this bill is a great idea.

However, it does illustrate a point I have repeatedly made. That is…nationwide background checks are not only a good idea, but practically required in order to get the complete sordid past of a person.

Background Checks For Babysitters: New Jersey Providing This Week’s Example

New Jersey once again reminds us why it’s a good idea to investigate exactly who it is that you entrust your children to. “Sloshed to the gills” as the article from newjerseynewsroom put it, should never describe a babysitter pushing a baby in a stroller, especially at 10:00 AM.

That is the time of day police in South Amboy New Jersey say they spotted Peder stumbling across a lawn and almost tripping over a curb as she pushed a baby carriage. Officers knew she had an outstanding warrant and went to question her and see if the baby was OK. Providing a false name was good for an arrest and a hindering charge.

Parents concerned about whom they are entrusting their children to will find a background check to be a helpful resource in weeding out the potheads and other questionable characters. With access to background checks a very easy matter, there is really no excuse for skipping this important step.

Peder pleaded guilty to child endangerment at her hearing in February, but failed to show for her sentencing in April of this year. When the incident occurred in November of 2009, police found an abundance of evidence of drug abuse in Peder’s personal possessions, including six hypodermic needles, prescription pain killer, and a straw with white powder.

One could say that is a lot of red flags that the parents missed. Or one could make sure not to get caught napping. Protect Your Child: Your Sitter May Have Multiple Criminal Records

It seems that no matter where you look, there are stories in the news of babysitters abusing their charges. Case in point, a quick search of the news from yesterday brought up two new instances, one in Chicago, Illinois and one in Houston, Texas.

In these two instances, details are sketchy because the cases have yet to be investigated. However, a common thread appears to be that the perpetrator becomes angry or frustrated with the child, and ends up injuring them. The case in Houston, Texas confirms this, where investigators allege that the babysitter Jordan Thomas Harris became angry with the 11-month old boy when he started crying, and injured him.

Details are even more incomplete in the story from Chicago, Illinois. In this case, the babysitter Abigail Cihak is accused of fracturing the skull of a nine month old baby girl.

Are Child Care Background Checks Overrated?

I came across an article by the Huffington Post that addresses the mass hysteria surrounding background checks on people who will be in contact with children.

It seems people have lost most of their common sense when it comes to selecting a baby sitter, or other child care provider. In England, for example, 25% of the population will have to undergo some kind of background check under a new law. Does that mean that one quarter of the population is a pedophile? Absolutely not.

While it’s good to conduct a background check if you are gong to hire a nanny, babysitter, or daycare teacher, I believe England has gone off the deep end. Don’t be surprised by this however, England has been tightening the rules for some time. For example, they require require member lists for practically every type of organization in the Country.

How To Do a Nanny Background Check

Now for a topic that is receiving more nationwide attention; nanny background checks. Lately there has been a rash of incidents involving day care centers and care-takers. Here is just one example. A childcare worker in a daycare center, Talisha Lavette Smith was given five years of probation after pleading guilty to slapping a 7-month old girl so hard it caused bleeding in her brain. That may be a little harsh, but you get the point. Don’t let any caretaker near you children without being sure of the facts, even if it means locating them yourself.
